1. Acceptance of Terms

By accessing or using the services provided by Thakur Technologies ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Services

Thakur Technologies provides software development, app development, website development, and ERP solutions for businesses and individuals. Our services include but are not limited to custom software development, mobile application development, web development, ERP implementation, IT consulting, and technical support.

3. User Responsibilities

You are responsible for:

• Providing accurate and complete information when using our services.
• Maintaining the confidentiality of any account credentials provided to you.
• Ensuring that your use of our services complies with all applicable laws and regulations.
• Obtaining and maintaining any equipment or services needed to access and use our services.

4. Intellectual Property Rights

All content, features, and functionality of our services, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, are the exclusive property of Thakur Technologies or its licensors and are protected by copyright, trademark, and other intellectual property laws.

Unless otherwise specified in a separate agreement, the intellectual property rights to custom software, applications, or websites developed for clients will be transferred to the client upon full payment for the services rendered.

5. Payment Terms

Payment terms for our services will be specified in the project proposal or contract provided to you. Unless otherwise stated, payment is due within 30 days of invoice date. Late payments may be subject to interest charges.

For ongoing services, we may require recurring payments, which will be outlined in the service agreement.

6. Limitation of Liability

To the maximum extent permitted by law, Thakur Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use our services.
• Any unauthorized access to or use of our servers and/or any personal information stored therein.
• Any interruption or cessation of transmission to or from our services.
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our services.

7. Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms of Service.

Upon termination, your right to use our services will immediately cease. All provisions of these Terms of Service which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

8. Governing Law

These Terms of Service shall be governed and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms of Service will not be considered a waiver of those rights.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms of Service at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
